Council set to legalize duplex at 125 Baltimore Avenue
At 125 Baltimore Avenue, a two-unit residential building has sat for years out of step with its own zoning and General Plan designation, both of which currently call for single-family use. Tuesday's public hearing asks the Council to change the designations to match the building, not the other way around.
Staff is recommending the Council adopt Resolution No. 42/2026, which would redesignate the parcel from Low Density Residential to Medium Density Residential in the General Plan, and rezone it from R-1 Medium-Density Residential to R-2 Low-Density Multiple Dwelling. The effect would be to bring the existing legal nonconforming duplex into conformance with Town rules rather than requiring it to be altered or removed.
Because the change touches the General Plan, the ordinance needs to be introduced at Tuesday's hearing and come back for a second reading before it's final. The agenda packet includes no recorded neighbor comments ahead of the hearing.

Commercial zoning overhaul returns for final council vote
The Council introduced the Commercial Code Modernization Project 4-0 at its September 15 meeting, and Tuesday it comes back for final adoption as Ordinance No. 1061. The package amends both the streets-and-sidewalks title and the zoning title, with effects that reach commercial properties across town.
Among the changes: new rules allowing sidewalk vending and microbusinesses, reorganized land-use categories, reduced parking requirements in commercial districts, and a rezoning of 2 Tamalpais Drive from R-2 to C-1 to match its existing General Plan designation.
The microbusiness rules drew at least one enthusiastic public comment at the introduction hearing, from a resident who described wanting to run a coffee cart and community hub at Menke Park under the new regulations. Staff recommends the Council waive the second reading and adopt the ordinance as written Tuesday.
